Photography Contract

This Agreement/Contract is between Faith Flies Photography (hereafter referred to as ”Photographer”) and ___Senior's NAME ABOVE and SIGNED BELOW_(hereafter referred to as “Client”)

1.Scope of work: This agreement/contract is for services and products related to an event (hereafter referred to as “the shoot”) to take place at the following time and place.

The PHOTOGRAPHER will perform from basic to artistic editing services on these photos.

2. Payments: According to the photography services provided by the PHOTOGRAPHER, CLIENT agrees to pay the sum of _$___200.00__. CLIENT agrees to pay the photographer a non-refundable initial payment totaling 35% (thirty-five percent) of the total price of the photography services upon signing this contract.

2.1 The balance of the $_________450.00________ for the photography services must be paid in full no later than END OF FEBRUARY 2024. No new Photo Services will be made until FULL payment is received. In the event that the final payment is not honored by the end of session day, no photos shall be released until a payment is made and with an additional late fee of $100.00. 

3. Work Product: All photographs will be shot in digital format. Faith Flies Photography will provide CLIENT with edited Digital images and will make images available in an online gallery within, but not exceeding 8 weeks after the date of the SHOOT. Images will be delivered as HIGH-RES JPEG files in the online gallery. RAW files will not be provided, unless previously agreed upon and stated above in “details” part of the form. When the online gallery is available, it shall remain open for 60 Days from the gallery delivery date. Such an expiration date will be posted on the Gallery Home Page. Be advised that the RAW files may be destroyed at any time after the online gallery has expired. 

PHOTOGRAPHER may provide a sample of __3__ edited images to CLIENT through social media “instagram” Faith Flies Photography account and notify CLIENT of the display. 

4. Indemnification: PHOTOGRAPHER and CLIENT agree that PHOTOGRAPHER is in no obligation to capture and specific moment, or pose, or person(s) during SHOOT, unless specified on the BOOKING FORM provided at contract acceptance. 

4.1- If PHOTOGRAPHER is unable to perform the services in this contract for any cause outside PHOTOGRAPHERS control (illness, emergency, fire, casualty strike, unsafe environment, threat, act of God or any cause outside it’s control: PHOTOGRAPHER will make reasonable efforts to reschedule said session.

 CLIENT agrees to indemnify the photographer for any damage, loss, liability; however, PHOTOGRAPHER will return in full all payments made by CLIENT to PHOTOGRAPHER in relation to this SHOOT.

4.2- CLIENT agrees to indemnify and hold harmless PHOTOGRAPHER for any damage, liability, or loss related to technological failure, including data loss.

4.3- CLIENT agrees to hold PHOTOGRAPHER harmless for any personal injury, which may occur as the CLIENT poses or works with the PHOTOGRAPHER.

4.4- PHOTOGRAPHER will strive to present photos in a workmanlike manner but is not required to cater to specific aesthetic preference of CLIENT. If the Photographer does not appear at a photography session the deposit will be fully refunded to the client.

4.5. When the online gallery is available, it shall remain open for 60 Days from the gallery delivery date. Such expiration date will be posted on the Gallery Home Page. Be advised that the RAW files may be destroyed at any time after the online gallery has expired. CLIENT has 60 days to make PHOTOGRAPHER aware of any issues, discrepancy, technical problem or any other complaint regarding photos, their quality and contents, or anything relating to session coverage. After the 60 day term has expired, PHOTOGRAPHER will no longer be liable to CLIENT for any corrections, damages, refunds, re-edits or re-shoots. If after the 60 day term has expired and CLIENT wants any Re-edits made by PHOTOGRAPHER there will be a $60 per hour plus GST (goods and service tax) for retouching will be billed with a minimum of one hour required. 

4.6 The final post production and editing styles, effects, and overall look of the images are left to the discretion of the PHOTOGRAPHER. 

4.7 PHOTOGRAPHER reserves the right to terminate coverage and leave the location of the SHOOT if the PHOTOGRAPHER experiences inappropriate, threatening, hostile or offensive behavior from anyone at the SHOOT: or in the event that the safety of the photographer is in question. If PHOTOGRAPHER leaves the SHOOT in this case with this clause, PHOTOGRAPHER will not be liable to refund any amount to CLIENT, but will be obligated to provide CLIENT with photographs taken by PHOTOGRAPHER prior to PHOTOGRAPHER leaving the SHOOT.

5. DUTY of CLIENT/ Cancelation: The Client agrees to be no more than 15 minutes late to the appointed shoot. In the event the CLIENT cancels six weeks from the SHOOT the 35% deposit will be non-refundable.

6.  Permissions and Permits: CLIENT will obtain all permissions necessary for PHOTOGRAPHER to photograph at the SHOOT. PHOTOGRAPHER has no duty to obtain permission of reception centers, churches, buildings, properties, national parks or other locations. CLIENT understands and agrees that any failure to obtain these permissions resulting in fines to the photographer, or which prevents the PHOTOGRAPHER from photographing the SHOOT is not the fault, liable, or responsibility of the PHOTOGRAPHER. CLIENT agrees to pay the PHOTOGRAPHER an amount equal to any fine which may be imposed upon PHOTOGRAPHER as a result of the CLIENT’s failure to obtain any required permission.

7. Model Release: I hereby grant the absolute full rights and unrestricted permission concerning any of my photos that he/she photographer from Faith Flies Photography has taken or may take of me with or without my name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and any blogging content. I agree the photos may be combined with others, to use, reuse, publish, and re-publish the photographs in whole or in part, individually, or in connection to other material, text, graphics, film, audio, audio visual works and may be cropped, altered and or modified now or hereafter known, including the internet, and for any purpose whatsoever, specifically including art, editorial, advertising, without restriction as to alteration: and to use Faith Flies Photography name in connection with any use if he/she chooses. I hereby relinquish any and all rights to inspect or approve the finished product or copy of any use thereafter. I acknowledge and agree that I have consented to publication of my ethnicity and understand I may be associated with other ethnicities by the photographer for descriptive purposes. I may be entitled in connection with the picture. I release and discharge Faith Flies Photography photographer he/she from any and all claims and demands that may arise out of or in connection with the use of the photographs, including without limitation any and all claims or libel or violation of any right of publicity or privacy. I agree that I have no rights to the content and all rights belong to the photographer.  I have no further rights conditional to accounting, and that I will make no further claims for any reason to Faith Flies Photography.It is agreed that my personal information will not be made publicly available. I acknowledge and agree that this is binding upon signature to Faith Flies Photography.

8. CLIENT understands and agrees Faith Flies Photography retains the copyright to all the photographs taken, and allows the client to use, but non-exclusive rights to use photographs (personal use or use of the pictures as part of personal modeling portfolio.) 

I HAVE READ AND UNDERSTAND THE ABOVE:  

     I represent that I am at least 18 years of age and have full legal capacity to sign release. 

Parent Legal Guardian information: Model is a minor or lacks capacity to sign, so parent or legal guardian warrants and represents that the parent or legal guardian of the model has full capacity to consent to the shoot and to execute this release of all rights in the model's content.
